Terms and Conditions for Gemini Web Design

1. Agreement Overview

By engaging Gemini Web Design (“we,” “us,” or “our”) for web design and related services, you (“client”) agree to the following Terms and Conditions.

 

2. Payment Terms

– A 50% non-refundable deposit is required upon agreement of the project scope.

– The remaining 50% is due upon project completion and before the final delivery of the website.

– All payments must be made via Electronic Funds Transfer (EFT). Late payments may result in project delays.

– Proof of payment must be emailed to, info@geminiwebdesign.co.za

 

3. Project Scope and Revisions

– The project scope will be clearly outlined and agreed upon before work begins.

– Our designs use free stock footage where appropriate. However, the use of paid stock footage or premium assets will incur additional charges.

– Additional requests or changes beyond the agreed scope may incur extra charges.

– Minor revisions are included; significant changes are subject to additional fees.

 

4. Client Responsibilities

– The client must provide all necessary materials (content, images, branding assets) in a timely manner.

– Delays in providing required materials may impact project timelines.

 

5. Project Timeline

– Estimated project timelines will be provided but are subject to change due to unforeseen circumstances or client delays.

 

6. Intellectual Property

– Upon full payment, the client owns the website design and content.

– Gemini Web Design retains the right to showcase completed projects in our portfolio.

 
7. Third-Party Services

– Gemini Web Design may use third-party services (plugins, themes, hosting providers) as needed.

– We are not responsible for issues arising from third-party services but will assist in resolving them where possible.

 

8. Limitation of Liability

– Gemini Web Design is not liable for any direct, indirect, or incidental damages resulting from the use of our services.

– We are not responsible for any data loss, security breaches, or downtime once the website is handed over.

 
9. Termination Policy

– Either party may terminate the agreement with written notice.

– If the client terminates the project after the deposit is paid, the deposit is non-refundable.

– If termination occurs after significant progress, additional charges may apply based on completed work.

 
10. Governing Law

These Terms and Conditions are governed by the laws of South Africa.
